Terms and conditions

1. Scope

These terms and conditions apply to all orders placed through the online shop nachtseide.ch, operated by Nachtseide, Philip Guelat, Reuchenettestrasse 106, 2504 Biel (hereinafter “Nachtseide”). Deviating terms of the customer are not recognised.

2. Conclusion of contract

The presentation of products in the shop is not a binding offer. By completing your order, you make a binding offer. The contract is concluded with our shipping confirmation by email. We reserve the right to decline orders without giving reasons, in particular in the event of unavailability or obvious pricing errors.

3. Prices

All prices are in Swiss francs (CHF) and are final prices for consumers. Swiss VAT is included where we are liable for it; currently no VAT is shown separately. Shipping costs are shown separately during checkout.

4. Payment

We accept Twint, credit cards (Visa, Mastercard, American Express), Apple Pay, Google Pay, Klarna and other payment methods shown at checkout. Payment is due upon ordering. Payment is processed by Shopify Payments; your card details go straight to the payment provider and we never receive or store them. The goods remain the property of Nachtseide until paid in full.

5. Delivery

We deliver within Switzerland with Swiss Post. Delivery usually takes 1–3 working days after dispatch; processing takes 1–2 working days. Shipping costs: CHF 7.00; free shipping on orders from CHF 60. All parcels are sent from Switzerland – no customs charges apply.

6. Returns

In Switzerland there is no statutory right of withdrawal for online purchases. Nachtseide voluntarily grants a 14-day right of return from receipt for unworn, unwashed items in their original packaging. For hygiene reasons, used sleep masks, bonnets, scrunchies and pillowcases cannot be taken back. See “Returns” for details.

7. Warranty

The statutory warranty provisions of the Swiss Code of Obligations apply. Defects must be reported to us at hello@nachtseide.ch within a reasonable time after discovery. In the case of justified complaints we will, at our discretion, provide a replacement, a repair or a refund.

8. Liability

Nachtseide is only liable for damage caused by intent or gross negligence. Liability for slight negligence and for indirect and consequential damage is excluded to the extent permitted by law.

9. Data protection

The processing of personal data is governed by our privacy policy.

10. Applicable law and place of jurisdiction

Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Biel/Bienne, unless mandatory statutory provisions provide otherwise. Mandatory consumer-protection provisions at the customer's place of residence remain reserved. We are not obliged to take part in dispute-resolution proceedings before a consumer arbitration body, and we prefer to settle matters directly – write to us first and we will try to resolve it.

11. Severability

Should individual provisions of these terms be invalid, the validity of the remaining provisions remains unaffected.

12. Language versions

These terms are available in German, French and English. In the event of discrepancies between the language versions, the German version prevails.
